Terms of Service
Version dated 1 November 2026. Sigma is operated by 365 Sigma, Amsterdam.
1 Sigma and these terms
Sigma is operated by 365 Sigma, Amsterdam, the Netherlands. Chamber of Commerce number: 34366254. VAT number: NL002187295B83. Contact: service@365sigma.com. These terms govern the Sigma website, personal leadership app and any Training, Nutrition or other service included in an offer you accept. The informational guidance and risk notices also apply to content Sigma publishes through its official social-media accounts, newsletters and other communications. The relevant social platform’s own terms also apply. We provide these terms before you enter into a service agreement.
2 Eligibility and responsible use
You must be at least 18 years old to create an account. Provide accurate account information, keep credentials secure and contact us if you suspect unauthorised access. You are responsible for activity you authorise, not automatically for unauthorised activity caused by our own failures.
Use Sigma lawfully. Do not access other accounts without permission, disrupt the service, introduce malicious software, send unsolicited bulk invitations or unlawfully disclose other people’s private information. These restrictions do not limit rights expressly permitted by applicable law.
3 Access and acceptance
Your accepted offer identifies the services, access period, price and included features. When you create an account or purchase a service, we ask you to acknowledge and accept these terms before completing registration or purchase. Material technical requirements and limitations are explained before you agree. Planned features are not included unless expressly stated in your offer.
Merely viewing our website or social content, following an account or joining a waiting list does not create a paid subscription, authorise payment, provide consent to personal-data processing or waive statutory rights. Where a feature is described as beta, preview or early access, that description identifies its development status. It does not reduce our contractual obligations or your statutory rights.
4 Subscriptions, prices and billing
The plans available at the time of purchase and their prices are shown on our pricing page and in the offer presented before payment. Your order confirmation records the agreed plan, included services, total price, subscription period and payment schedule. Those agreed terms govern your purchase; a later change to a public pricing page does not retrospectively change your agreement.
An annual plan provides access for 12 months from its agreed start date and is paid upfront where stated in your offer. A daily equivalent shown for an annual price is illustrative; it does not create daily billing or daily cancellation. A monthly subscription is billed for the agreed product or bundle and may be cancelled with effect from the end of the current monthly billing period.
Where we offer a free or discounted trial, we explain its duration, any payment details required, what it includes and what happens afterwards before enrolment. It converts to paid access only where the price, first payment date and recurring arrangement have been clearly disclosed and expressly accepted. A promotional trial is separate from statutory withdrawal rights.
Consumer prices include VAT where applicable. Before purchase, we disclose any automatic renewal, renewal period and cancellation arrangements. No automatic renewal or recurring payment arises merely from viewing content or joining a waiting list. You may give notice of cancellation before the next renewal through the available subscription controls or by emailing service@365sigma.com. Cancellation stops the next renewal and ordinarily leaves access available until the end of the paid period, without affecting statutory rights to earlier termination or a refund.
Price changes are communicated in advance and applied in accordance with the agreement and applicable law. They do not retrospectively alter a period already paid for. Switching plans requires confirmation of the new price, effective date and treatment of any remaining prepaid period.
Cancellation does not remove any right to withdraw, receive a refund or seek a remedy for a service that does not meet the agreement. Contact service@365sigma.com if you need help cancelling.
5 Consumer withdrawal rights
Where statutory withdrawal rights apply, you may withdraw from an online service agreement within 14 days after it is concluded without giving a reason. Notify service@365sigma.com or use the available online withdrawal function. A clear statement is sufficient; the optional form below may also be used.
Where a refund is due, we provide it within the applicable legal period, normally within 14 days of receiving your withdrawal notice, using the original payment method unless otherwise agreed without additional cost to you.
If you expressly request a paid service to begin during the withdrawal period, a proportionate amount may be payable for service already supplied only where the legal conditions are met. Different rules may apply to immediately supplied digital content and fully performed services. We explain any applicable exception and obtain the specific consent and acknowledgement required before relying on it. Merely accepting these terms does not waive withdrawal rights.
6 Your content and Sigma materials
You retain ownership of your entries, reflections, uploads and other original content. You give us limited, non-exclusive permission to store, reproduce, process and display it as necessary to provide the service you request, subject to the Privacy Policy and applicable data-protection requirements.
This permission does not authorise publication of private entries, advertising use or unrelated processing. Use of identifiable content or feedback as a public testimonial requires a separate agreement.
Sigma branding, software and original materials remain protected by their owners’ rights. You may use supplied materials for your own participation. Do not sell, commercially redistribute or present protected materials as your own without permission. This does not limit rights under applicable law or claim ownership of your personal insights.
7 Informational guidance and AI
Sigma provides tools and general educational information for reflection, planning and personal development. Unless expressly agreed in a separate professional engagement, its content, assessments, calculations, plans and AI outputs do not constitute medical, psychological, financial, investment, legal, tax or other regulated professional advice. They do not establish a clinician–patient, adviser–client or fiduciary relationship.
AI outputs may be inaccurate, incomplete or unsuitable for your circumstances. Independently verify information and seek appropriately qualified advice before decisions that could materially affect your health, finances, legal position or other important interests. Do not rely solely on Sigma for decisions that may cause serious, lasting or irreversible consequences. Sigma does not guarantee any particular outcome. These limitations do not alter the services expressly promised or remove our legal duties. Data processing and human access are explained in the Privacy Policy.
8 Training, nutrition and health
Training and Nutrition are included only as stated in your accepted plan. The relevant offer identifies delivery arrangements, provider, included support and material participation requirements.
General reflection, fitness, nutrition and wellbeing materials do not constitute medical diagnosis, treatment, therapy or emergency support. Any expressly agreed professional service is limited to the scope and qualifications stated in its offer.
Choose activities suited to your circumstances and follow safety instructions. Seek advice from an appropriately qualified professional where a condition, injury, medication or other circumstance may affect suitability. Do not follow suggestions that conflict with professional advice, an allergy or a known limitation. Stop activity if you experience concerning symptoms and seek appropriate help.
Sigma does not continuously monitor your wellbeing or provide emergency response. Your responsibility for your choices does not remove a duty owed by Sigma or another provider.
9 Service quality and availability
We provide the service with reasonable care and skill and meet applicable legal requirements. Maintenance, faults or external disruption may interrupt access. We do not promise uninterrupted availability but take reasonable steps to address problems. Required updates, including security updates, are provided in accordance with the agreement and applicable law.
If the service does not meet the agreement, contact us. Applicable rights to correction, price reduction, termination or refund remain intact. Keeping an export of important records is sensible but does not transfer our legal responsibilities to you.
10 Changes and ending access
Changes to the service or these terms may be needed for security, legal requirements, technical improvements or operational reasons. Changes must respect your agreement and statutory rights. We explain material changes, their effective date and any right to end the agreement, with advance notice in a form you can retain where required.
A terms update does not itself create a new paid commitment or supply new data-processing consent.
We may restrict access where reasonably necessary to address serious breaches, unlawful activity or security risks. Where appropriate, we explain the reason and give an opportunity to resolve the issue. Immediate action may be necessary to protect people or the service.
If we discontinue a service, we give reasonable notice and an opportunity to retrieve content where practicable and legally required. Refund and other statutory rights remain intact.
Account deletion, subscription cancellation and email unsubscribe are different actions. Deletion does not replace a cancellation request. Contact us for help. Following termination, content and personal data are handled under the Privacy Policy and applicable law.
11 Own risk, liability and third-party claims
Your participation and decisions are voluntary. You use general information and choose whether to act on suggestions at your own risk as regards the inherent risks of your activities and decisions. Consider your circumstances, obtain appropriate professional advice and follow safety instructions. This does not transfer to you risks caused by Sigma’s breach of its contractual or legal duties.
Sigma is not responsible for loss to the extent caused by your unlawful use, unauthorised alteration of materials, disregard of applicable safety instructions or other misuse, rather than a breach of Sigma’s own duties. An unwanted result does not by itself establish that Sigma breached its obligations. You remain entitled to make a complaint, bring a claim and exercise statutory remedies.
If a third party makes a claim against Sigma directly resulting from your intentional unlawful use of the service or your knowing infringement of that party’s intellectual-property or privacy rights, you must compensate Sigma for reasonable, demonstrable losses and reasonable defence costs attributable to that conduct, but only to the extent you are legally responsible. This indemnity does not cover Sigma’s own breach, negligence or other fault, claims arising from ordinary authorised use, or amounts that cannot lawfully be recovered from a consumer.
We will notify you promptly of a relevant third-party claim, provide reasonable information, allow you a reasonable opportunity to participate in the defence and take reasonable steps to limit loss. We will not agree to a settlement imposing payment or other obligations on you without your consent, which must not be unreasonably withheld.
Nothing in these terms excludes or limits mandatory consumer remedies, data-protection rights or liability that cannot lawfully be excluded, including applicable liability for death or personal injury, fraud or intentional misconduct. No clause requires you to waive a claim or compensate Sigma for its own legally attributable failures.
12 Privacy communications and complaints
The Privacy Policy explains personal-data processing and your rights. It is an information notice, not blanket consent. Necessary account, security and support messages may be sent to administer the service. Optional marketing follows your subscription choices.
Send questions or complaints to service@365sigma.com with enough information to investigate, without passwords or unnecessary sensitive details. Do not rely on support messages or journal entries for urgent assistance.
13 Applicable law
Dutch law applies. If you are a consumer, this does not deprive you of mandatory protections under the law that would otherwise apply in your country of habitual residence. Disputes may be brought before courts competent under applicable law. These terms do not remove a court or remedy available under mandatory consumer law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
